Part I - Terms of Service

1. Agreement to Terms

By accessing or using the zblocks platform, website at zblocks.app, any associated subdomains, mobile applications, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”), our Acceptable Use Policy (Part II of this document), and our Privacy Policy (collectively, the “Agreement”). If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to this Agreement.

If you do not agree to all the terms in this Agreement, you may not use or access the Services.

“zblocks,” “we,” “us,” and “our” refer to Zinkosoft LLC, a Florida limited liability company. “You” and “your” refer to the individual or entity accessing or using the Services.

2. Description of Services

zblocks is a website building platform that enables users to create, publish, and manage websites using a block-based visual editor. The Services include, but are not limited to:

  • The zblocks visual website editor and block-based design tools
  • Website hosting on zblocks.app subdomains and custom domains
  • Built-in analytics dashboard
  • Contact forms, newsletter signup, and blog functionality
  • File storage for images, documents, and media assets
  • Domain management and SSL certificate provisioning

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will endeavor to provide reasonable notice before making material changes.

3. Accounts and Registration

To use most features of the Services, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information to keep it accurate and current
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to create an account. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to suspend or terminate accounts that we reasonably believe contain false or misleading registration information.

4. Subscription Plans and Billing

4.1 Plans

zblocks offers a free tier and multiple paid subscription plans (“Paid Plans”). The features, limitations, and pricing of each plan are described on our pricing page at zblocks.app/pricing and may be updated from time to time. The current tiers are Free, Starter, Pro, and Business.

4.2 Billing and Payment

Paid Plans are billed on a recurring basis (monthly or annual, depending on your selection) through our third-party payment processor, Stripe. By subscribing to a Paid Plan, you authorize us to charge your designated payment method on each billing cycle. All fees are stated in U.S. dollars unless otherwise indicated.

We use Stripe to handle all payment processing. Your payment information is transmitted directly to Stripe and is never stored on zblocks servers.

4.3 Automatic Renewal

Paid Plans automatically renew at the end of each billing cycle at the then-current rate unless you cancel before the renewal date. Annual plans renew annually. We will attempt to notify you before any price increase takes effect on your next renewal.

4.4 Cancellation and Refunds

You may cancel your Paid Plan at any time through your account dashboard. Upon cancellation, your plan remains active through the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you cancel a Paid Plan, your account will revert to the Free tier at the end of your billing cycle, and premium features will become unavailable.

If you believe you have been charged in error, please contact us at support@zblocks.app within 30 days of the charge.

4.5 Free Tier

The free tier includes a single site with up to three pages, hosted on a zblocks.app subdomain, with zblocks branding displayed on published pages. Free-tier published sites may display a small advertising banner and a “Made with zblocks” badge. Upgrading to a Paid Plan removes the advertising banner and zblocks branding.

5. Your Content

5.1 Ownership

You retain all ownership rights to the content you create, upload, publish, or display through the Services (“Your Content”). This includes text, images, logos, documents, videos, audio files, code, and any other materials you provide. zblocks does not claim ownership of Your Content.

5.2 License to zblocks

By uploading or publishing Your Content through the Services, you grant zblocks a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, transmit, display, and distribute Your Content solely for the purpose of operating, providing, and improving the Services. This license continues for as long as Your Content remains on the platform and terminates when you delete Your Content or close your account, except as required to maintain backups or comply with legal obligations.

5.3 Responsibility for Your Content

You are solely responsible for Your Content and the consequences of publishing it. You represent and warrant that: (a) you own or have the necessary rights, licenses, and permissions to use and authorize zblocks to use Your Content as described in these Terms; (b) Your Content does not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights; and (c) Your Content complies with our Acceptable Use Policy and all applicable laws.

5.4 Content of Your End Users

Your published websites may have their own visitors, customers, and users (“End Users”). You are solely responsible for your End Users, for their experience on your site, and for any data you collect from them. zblocks does not have a direct relationship with your End Users and is not responsible for how you process or handle their information. You must comply with all applicable data protection and privacy laws in connection with any personal data you collect through your sites.

6. Published Sites and Hosting

6.1 Subdomain Hosting

Sites are initially published on a zblocks.app subdomain (e.g., yoursite.zblocks.app). Subdomain names are assigned on a first-come, first-served basis. We reserve the right to reclaim subdomains that are inactive, infringing, or misleading, or that conflict with reserved system names.

6.2 Custom Domains

Paid Plan users may connect custom domains to their sites. Domain configuration requires adding DNS records at your domain registrar. zblocks will provision SSL certificates automatically for connected custom domains via our infrastructure partner, Cloudflare. You are responsible for maintaining your domain registration and DNS configuration.

6.3 Uptime

We strive to maintain high availability for the Services but do not guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss resulting from such interruptions.

7. Intellectual Property

7.1 Our Intellectual Property

The Services, including all software, code, design, text, graphics, logos, trademarks, and other materials provided by zblocks (collectively, “zblocks Content”), are owned by or licensed to Zinkosoft LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any zblocks Content without our prior written consent, except as permitted by these Terms.

7.2 Templates and Blocks

zblocks may provide pre-designed templates, block layouts, and design elements for use within the Services. You are granted a non-exclusive, non-transferable license to use these elements solely in connection with sites you build on the zblocks platform. This license does not transfer ownership of the underlying design assets.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Services (“Feedback”), you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such Feedback into the Services without any obligation or compensation to you.

8. Third-Party Services and Integrations

The Services may integrate with or contain links to third-party services, including but not limited to Stripe (payment processing), Cloudflare (CDN and DNS), Resend (email delivery), and Umami (analytics). Your use of any third-party service is governed by that service’s own terms and privacy policies. zblocks is not responsible for the availability, accuracy, or practices of any third-party service.

9. Data and Privacy

Our collection and use of personal information in connection with the Services is described in our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

We implement commercially reasonable technical and organizational security measures to protect your data. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Warranty Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. zblocks does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Services is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Zinkosoft LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Services.

Our total aggregate liability for all claims arising under or related to these Terms shall not exceed the greater of: (a) the amounts you paid to us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Zinkosoft LLC and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms or any applicable law; (d) your violation of any third party’s rights; or (e) the content, operation, or use of any site you create using the Services.

13. Termination

13.1 By You

You may close your account and stop using the Services at any time by contacting us or using the account deletion feature in your dashboard. Upon account closure, we will delete Your Content within a commercially reasonable time, subject to our backup retention schedule and any legal obligations.

13.2 By Us

We may suspend or terminate your account and access to the Services, with or without notice, if we reasonably believe that: (a) you have violated these Terms or the Acceptable Use Policy; (b) your use of the Services poses a security risk or may cause harm to other users; (c) your account has been inactive for an extended period; or (d) we are required to do so by law. We will endeavor to provide advance notice before termination except where prohibited by law or where immediate action is necessary to protect the Services or other users.

13.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. Your published sites will be taken offline. We may retain certain data as required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms). Sections that by their nature should survive termination shall survive, including but not limited to: Your Content (Section 5), Intellectual Property (Section 7), Disclaimers (Section 10), Limitation of Liability (Section 11), Indemnification (Section 12), and Governing Law (Section 16).

14. Copyright and DMCA

zblocks respects the intellectual property rights of others. If you believe that any content on a site hosted through our Services infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent at:

Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good faith belief that the use is unauthorized; (e) a statement under penalty of perjury that your notice is accurate; and (f) your physical or electronic signature.

We may remove or disable access to allegedly infringing content and may terminate the accounts of repeat infringers in appropriate circumstances.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at legal@zblocks.app and attempt to resolve the dispute informally for at least thirty (30) days.

15.2 Arbitration

If the dispute is not resolved informally, you and Zinkosoft LLC agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except that either party may bring claims in small claims court if eligible. Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Pinellas County, Florida, or at another mutually agreed location, and may be conducted remotely to the extent permitted by the AAA rules.

15.3 Class Action Waiver

You and Zinkosoft LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative action. If this provision is found to be unenforceable, the entirety of this arbitration section shall be void.

15.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@zblocks.app within thirty (30) days of first accepting these Terms. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.

16. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by posting a prominent notice on the Services at least thirty (30) days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services before the effective date.

18. General Provisions

Entire Agreement. This Agreement constitutes the entire agreement between you and Zinkosoft LLC regarding the Services and supersedes all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, or internet or infrastructure failures.

Part II - Acceptable Use Policy

This Acceptable Use Policy (“AUP”) outlines prohibited uses of the zblocks platform. This AUP is incorporated by reference into the zblocks Terms of Service. Any capitalized terms not defined here have the meanings set forth in the Terms of Service.

1. General Principles

zblocks is used by individuals and businesses to build professional websites. We are proud of the creative and productive ways people use our platform. We expect all users to use the Services responsibly and lawfully.

All data, content, and information you store on or publish through zblocks is your own. Zinkosoft LLC has no affiliation with and does not endorse, sponsor, or assume responsibility for any user-generated content. You are solely responsible for ensuring that Your Content complies with applicable laws and this AUP.

2. Prohibited Content

You may not use the Services to create, store, publish, host, or transmit any of the following:

2.1 Illegal Content

  • Content that violates any applicable local, state, national, or international law or regulation
  • Content that promotes, facilitates, or instructs others in illegal activities
  • Content related to the sale of illegal drugs, controlled substances, or drug paraphernalia
  • Content related to illegal gambling operations

2.2 Harmful and Exploitative Content

  • Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors in any way
  • Non-consensual intimate imagery (“revenge porn”) or voyeuristic content
  • Content that promotes or glorifies self-harm, suicide, or eating disorders
  • Content designed to harass, bully, threaten, intimidate, or stalk any individual
  • Content that promotes terrorism, violent extremism, or provides instructions for acts of violence

2.3 Hateful and Defamatory Content

  • Content that promotes hatred, discrimination, or violence against any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or veteran status
  • Smear campaigns, coordinated defamation, or content primarily designed to damage the reputation of a specific individual or organization through false or misleading statements
  • Content promoting or supporting white supremacist, neo-Nazi, or comparable hate group ideologies

2.4 Adult and Sexually Explicit Content

  • Pornographic content, including images, videos, text, or audio that depicts or describes sexual acts
  • Sexually explicit material of any kind, including content behind paywalls or login walls
  • Escort services, adult entertainment services, or solicitation of sexual services

This restriction applies regardless of whether the content is legal in your jurisdiction. Our payment processing partners and infrastructure providers require that we maintain this policy across the platform.

2.5 Fraudulent and Deceptive Content

  • Phishing pages or content designed to deceive users into revealing personal information, credentials, or financial data
  • Scam or fraudulent schemes, including Ponzi schemes, pyramid schemes, and advance-fee fraud
  • Counterfeit goods or unauthorized replicas presented as genuine products
  • Deliberately false or misleading health, safety, or scientific claims
  • Impersonation of any individual, organization, or government entity

2.6 Intellectual Property Violations

  • Content that infringes any copyright, trademark, trade secret, patent, or other intellectual property right
  • Pirated software, media, or other copyrighted material
  • Tools, services, or content designed to circumvent digital rights management (DRM) protections

3. Prohibited Activities

You may not engage in any of the following activities in connection with the Services:

3.1 Security and Integrity

  • Attempting to gain unauthorized access to the Services, other user accounts, or any systems or networks connected to the Services
  • Distributing malware, viruses, trojans, ransomware, spyware, or other malicious code through sites hosted on zblocks
  • Conducting denial-of-service attacks, port scanning, or other activities that disrupt or degrade the Services
  • Scraping, crawling, or otherwise extracting data from the Services in an automated manner except as permitted by our robots.txt or a separate written agreement
  • Attempting to reverse engineer, decompile, or disassemble any part of the Services
  • Using the Services to host command-and-control infrastructure, botnets, or cryptocurrency mining operations

3.2 Spam and Unsolicited Communications

  • Sending unsolicited bulk or commercial messages (spam) through the Services, including via built-in forms or newsletter features
  • Harvesting or collecting email addresses or other contact information from the Services for the purpose of sending unsolicited messages
  • Creating accounts or sites for the primary purpose of search engine manipulation or link schemes

3.3 Platform Misuse

  • Reselling, sublicensing, or providing access to the Services to third parties except as permitted under your plan (e.g., team seats on the Business plan)
  • Creating multiple free-tier accounts to circumvent plan limitations
  • Using the Services in a manner that consumes excessive resources or degrades performance for other users
  • Interfering with or disrupting the integrity or performance of the Services
  • Attempting to remove, alter, or obscure the zblocks branding on free-tier published sites

4. Content Responsibility and Disclaimer

zblocks is a platform, not a publisher. We do not pre-screen all user content and are not responsible for any content created, uploaded, or published by users. However, we reserve the right (but are not obligated) to monitor, review, and remove content that violates this AUP.

All data, content, text, images, files, and information stored on, uploaded to, or published through the Services is the sole property and responsibility of the user who created or uploaded it. Zinkosoft LLC makes no representations about, does not endorse, and assumes no liability for any user-generated content. Visitors to user-created sites assume all risk associated with their use of such sites.

5. Embedded and Third-Party Content

Sites built on zblocks may include embedded content from third-party sources (such as videos, maps, or widgets). You are responsible for ensuring that any embedded content complies with this AUP and applicable laws. We reserve the right to block or remove embedded content that we determine poses a security risk or violates this policy.

6. Enforcement

6.1 Our Rights

We reserve the right, in our sole discretion and without notice or liability, to:

  • Remove or disable access to any content that violates this AUP
  • Suspend or terminate accounts and published sites that violate this AUP
  • Report illegal activity and content to appropriate law enforcement authorities, including providing user information as required by law or legal process
  • Cooperate with law enforcement investigations
  • Withhold any refund of amounts paid for the Services if your account is terminated for AUP violations

6.2 Reporting Violations

If you become aware of any content or activity on the Services that you believe violates this AUP, please report it to abuse@zblocks.app. We will review all reports in good faith, but the final determination of whether content or conduct violates this AUP rests with us.

6.3 Appeal

If your content is removed or your account is suspended or terminated, you may appeal the decision by contacting us at appeals@zblocks.app within thirty (30) days. We will review your appeal and respond within a reasonable timeframe.

7. Changes to This Policy

We may modify this Acceptable Use Policy from time to time. We will post the most current version on our website and will endeavor to notify affected users of material changes. Your continued use of the Services after any changes indicates your acceptance of the updated policy.
